Terms of Use

These Terms of Use (“Terms”) govern your use of the Bitperfect Player app (“the App”). They cover the subscription, the free trial, billing, cancellation and refunds, and the limits of what is promised. How the App handles your data is a separate document: see the Privacy Policy.

1. Summary (non-binding: the full sections below govern)
- Bitperfect Player is a subscription app. There is one auto-renewing annual subscription at USD 35 per year.
- Eligible new customers may receive a free trial only when the current app-store offer includes one. The store shows the applicable duration, eligibility, and end date before you confirm. If you do not cancel before that trial ends, the first year is charged automatically.
- Everything is billed by the app store you downloaded the App from, never by us and never on this website. The store shows you the price in your own currency before you confirm.
- Cancel any time in your store account. Cancelling stops the next renewal; you keep access until the end of the period you already paid for.
- Refunds are requested from the store, because the store is who took the payment.
- Without an active trial or subscription, the App is not usable. There is no free tier or cut-down version.
- The base subscription is personal and covers up to five concurrently registered installations on devices you own or control. Active device-capacity packs raise that capacity in five-installation steps to 10, 15, or 20 concurrently registered installations. A capacity pack is not an App licence by itself: it works only while the base subscription is active and grants no right to use the App without that subscription. Do not share subscription access.
- The App is provided as is. Audio hardware, phones, and operating systems vary, and no particular result on your particular equipment is promised.

2. Accepting these Terms
By downloading, installing, or using the App, you agree to these Terms. If you do not agree to them, do not use the App. If you are under the minimum age required to hold an account with your app store, do not use the App or purchase a subscription.
Your purchase is also governed by the terms of the store you buy through (Google Play, or the Apple App Store where the App is offered there). Where a store’s own rules give you more than these Terms do, the store’s rules apply.
These Terms are the whole agreement. Nothing said elsewhere (on this website, in the store listing, in screenshots, in release notes, in a review, in a support reply, or in any promotional material) forms part of this agreement or creates a warranty. Descriptions of what the App does are descriptions, not guarantees, and you should not rely on them as promises of any specific outcome on your equipment.
3. What you may do with the App
You are granted a personal, non-exclusive, non-transferable, non-sublicensable, revocable licence to install and use the App on up to five concurrently registered installations by default. While your base subscription is active, active device-capacity packs raise the limit by five installations per pack, up to three packs and a maximum of 20 concurrently registered installations, on devices you own or control, for your own listening. A device capacity pack is ancillary to the base subscription: it is not a standalone licence, does not make the App usable by itself, and grants no access after the base subscription ends. Increasing capacity takes effect only when the store and subscription service confirm the change. A lower selected capacity may be scheduled for the next renewal; the current capacity remains available until the effective change date shown by the store. We reserve the right to modify future device limits, add-on availability, capacity, and pricing. All rights not expressly granted are reserved.
Your subscription is personal to you. You must not share your app-store account, purchase or restore access, subscription entitlement, or any other means of access to let another person use the App. It is not a family, household, group, business, or multi-user licence unless we expressly say otherwise in writing. A store feature that permits account, family, or device sharing does not expand this licence.
Each installation counts separately. Reinstalling the App or clearing its data may create a new installation. You can remove another registered installation from the subscription screen. Removal stops that installation from renewing subscription access, but an authorization already stored there may continue to work offline until it expires, for no longer than 14 days.
You may not resell, rent, lease, sublicense, or redistribute the App; you may not copy, modify, translate, decompile, disassemble, or reverse-engineer it or attempt to derive its source code, except to the extent applicable law expressly permits despite this restriction; and you may not bypass, disable, or interfere with the subscription check, the licence check, or any security measure.
The App plays music you already have: files on your device and on network sources you configure yourself. You are responsible for having the right to play, store, and copy that music. The App is not a music store, supplies no music, and provides no content of its own.
4. Subscription, free trial and price
4.1 Subscription and add-ons
Bitperfect Player is offered as an auto-renewing annual subscription providing access to the complete App and five registered installations. While that base subscription is active, you may add up to three auto-renewing annual device-capacity packs. Each active pack adds five installations, giving a capacity of 10, 15, or 20 in total. Capacity packs cannot be purchased or used as independent App licences and provide no App access without the base subscription.
Where supported, the store combines the selected capacity packs with the base subscription. An increase takes effect when the store and subscription service confirm it, and the store shows the applicable charge before you confirm. Reducing capacity is scheduled to take effect at the next renewal; the current higher capacity remains available until then. The store shows the effective date and any immediate charge before you confirm.
4.2 Free trial for eligible new customers
Eligible new customers may receive a free trial only when their current app-store offering contains a free trial phase. Eligibility and the duration are configured by the store, not by us. The store tells you before you confirm whether a trial applies to you and when it ends. Where no trial is offered, the subscription begins immediately and is charged at the price shown. The store may change or withdraw a trial for future customers at any time; that does not affect a trial already running.
4.3 Price and currency
The base subscription is USD 35 per year. Each 5-device capacity pack is currently USD 14.99 per year before any store-applied regional pricing or partial-period adjustment. If your store account is set to another currency, the store charges the regional equivalent it sets for your country, which may differ from a direct conversion of the US price and may include local taxes.
When a capacity pack is added part-way through a subscription year, the store may charge only for the remaining part of that year so that future renewals occur together. The exact amount and exact billing date shown by the store before you confirm are the ones that govern. Prices on this website are for information and may lag behind the store.
4.4 Automatic renewal and automatic charge after the trial
The subscription renews automatically:
- After a free trial: unless you cancel before the trial ends, your payment method is charged for the first year automatically, at the price the store showed you, on the day the trial ends. To be safe, cancel at least 24 hours before the trial ends. Stores begin processing renewals shortly before the period expires.
- After a paid year: your base subscription and any capacity packs bundled with it renew for another year and are charged automatically on the renewal date, unless you cancel or schedule a capacity reduction before then.
Renewal continues until you cancel. Cancelling the base subscription also ends the right to use capacity packs, even if a store continues to display an add-on transaction separately. Prices may change for future renewal periods; where they do, the store will notify you in advance as its rules require, and you can cancel before the change takes effect.
4.5 Payment is taken by the store, not by us
Payment is handled entirely by the app store, which is the seller of record for your purchase in most countries. This website and the App never take a payment, and we never see or store your card details or billing address. What is received in order to know that an install is entitled is described in the Privacy Policy.
Because the store takes the payment, the store’s billing terms, tax handling, payment methods, and dispute process apply to the transaction.
5. Cancelling
You can cancel at any time, and you cancel through your app store account, not through us:
- Google Play: Play Store app → your profile icon → Payments & subscriptions → Subscriptions → Bitperfect Player → Cancel subscription.
- Apple App Store: Settings → your name → Subscriptions → Bitperfect Player → Cancel subscription.
Cancelling takes effect at the end of the period you have already paid for: you keep full access until then, and you are not charged again. Cancelling during the free trial ends access when the trial ends and means no charge is taken. There is no account on our side to close, and deleting the App does not cancel a subscription on its own. Keeping track of your renewal date is your responsibility; the store shows it in your subscriptions screen.
6. Refunds
Cancellation ends the subscription at the end of the paid period, so a subscription is not refundable part-way through a period and there is no refund for unused time, whether the unused time comes from cancelling, from uninstalling the App, from changing devices, or from simply not using it.
Refunds are requested from the store that took your payment, under that store’s own refund policy and process. We do not process payments and so cannot issue, promise, or guarantee a refund; where a store chooses to grant one, that is the store’s decision under its own rules.
This section does not affect any right to a refund, cancellation, or withdrawal that mandatory consumer-protection law in your country of residence gives you, and nothing here is intended to exclude a remedy that cannot lawfully be excluded.
Feature performance varies across phones, audio hardware, and music libraries, and that variation is normal rather than a defect. Examples of things that are not defects: your device not appearing on the AI Enhancer’s list of supported devices, the Sonic Scan analysis of your library taking longer than you expected, a particular DAC or adapter behaving differently from another, or the audible result differing from what you hoped for.
If something looks broken, email support@bit-perfect.com first (see Section 9).
7. Restoring and managing your subscription
Your subscription belongs to your store account, not to a particular handset. If you reinstall the App, change phones, or clear the App’s data, open the App and use the restore option on the subscription screen (or sign in to the same store account) and your existing subscription is recognised again. The store does not charge you twice for the same subscription, and you never need an account with us to get your access back.
Restoring is only for the person who obtained the subscription to recover access on that person’s own devices. It must not be used to activate the App for other people. An installation beyond your current active capacity of 5, 10, 15, or 20 is refused until a registered installation is removed or its authorization expires. You can remove an old installation from the subscription screen on another registered device. If none is available, wait for the old authorization to expire within 14 days or contact support@bit-perfect.com. A store’s family- or device-sharing feature does not expand the personal licence in Section 3.
Restoring requires the store’s services to be reachable and your store account to be in good standing; neither is within our control.
8. Access to the App
Bitperfect Player is a subscription app. Without an active free trial or an active subscription, the App is not available for use: playback and its features are locked, and there is no free tier or reduced version. Your music files, your settings, and anything else stored locally are untouched and become available again as soon as a trial or subscription is active.
Access also depends on things outside our control: your device, its operating system, its storage and permissions, your network, your audio hardware, and the app store’s own services. Interruptions caused by any of those are not a failure of the subscription.
9. Support
Support is provided by email at support@bit-perfect.com on a reasonable-efforts basis. No response time, resolution time, uptime, or outcome is guaranteed, no service level is promised, and no separate support contract is created by these Terms or by the subscription. Support may be provided in English only.
10. Your responsibilities
- Your music and your sources. You are responsible for the legality of the music you play and for the servers, shares, and cast targets you connect the App to, including their security configuration.
- Your backups. You are solely responsible for backing up your audio files and for how your network storage (FTP/WebDAV/SMB) is set up. Keep your own backups.
- Your hearing and your equipment. You are responsible for the volume levels you set and for the equipment you connect, particularly external amplifiers, DACs, and headphones.
- Your device. You are responsible for keeping your device, its operating system, and its storage in a state where the App can run.
- No misuse. Do not attempt to break, bypass, or reverse the App’s subscription or licence checks, do not interfere with its operation or with the stores’ services, and do not use the App to infringe anyone’s rights or to break any law that applies to you.
11. Third-party plugins, stores and services
The App supports optional plugins, which are separate applications with their own developers, permissions, and terms, and it relies on third-party services such as app-store billing, subscription management, artwork catalogs, and crash reporting.
We do not inspect, audit, endorse, control, or take responsibility for the safety, accuracy, functionality, availability, pricing, or data practices of any third-party plugin, store, device, or service, and we are not liable for anything they do or fail to do, including outages, account suspensions, billing errors, policy changes, or the withdrawal of a service the App depends on. Review a plugin’s own terms and privacy policy before installing it.
12. The App is provided “as is”
The App and all of its features are provided “as is” and “as available”, with all faults, and without warranty or condition of any kind, express, implied, or statutory, including any implied warranty of merchantability, satisfactory quality, fitness for a particular purpose, accuracy, quiet enjoyment, or non-infringement. To the maximum extent permitted by applicable law, all such warranties are disclaimed.
In particular, and without limiting the above, there is no guarantee:
- that the App will be uninterrupted, timely, secure, error-free, or free of defects, or that defects will be corrected;
- that any feature will work, or continue to work, on your device, your operating-system version, your audio hardware, or your file formats: compatibility with any particular phone, DAC, adapter, driver, cable, dock, cast target, network share, or plugin is not promised;
- that any specific audio path, output mode, sample rate, bit depth, latency, or audible result will be achieved on your equipment, since that depends on your device, its operating system, its drivers, and the hardware you attach;
- that any feature will remain available: features may be changed, limited, or withdrawn, including where a third-party service or platform capability they depend on changes or disappears.
External hardware. The App uses standard operating-system audio interfaces and standard USB audio protocols to communicate with external digital-to-analog converters. Hardware variation, power delivery, cabling and adapter quality, custom audio drivers, and third-party DAC firmware behaviour all carry inherent risk. You connect external hardware and control your listening equipment at your own risk. To the maximum extent permitted by law, no liability is accepted for any hardware malfunction, electrical damage, firmware corruption, physical defect, overheating, battery drain, or failure of external USB DACs, amplifiers, headphones, speakers, or connected devices, nor for hearing loss, tinnitus, or acoustic trauma resulting from your use of the App or from audio playback.
Data and storage. To the maximum extent permitted by law, no liability is accepted for any file deletion, modification, corruption, or loss occurring on your device storage, external media, or remote network shares, or for any loss of settings, playlists, library data, or playback history.
Pre-release and optional features. Features labelled beta, experimental, preview, or optional are provided for evaluation, may be unstable or incomplete, and may be withdrawn without notice or liability.
13. Limitation of liability
To the maximum extent permitted by applicable law:
- (a) we are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, revenue, profits, goodwill, business, or anticipated savings, or for damage to hardware or other property, arising from or connected with the App or these Terms, whether in contract, tort (including negligence), strict liability, or any other theory, and even if the possibility of such damages was known or foreseeable; and
- (b) total aggregate liability for all claims arising from or connected with the App or these Terms is limited to the total amount you actually paid for the App in the 1 month preceding the event giving rise to the claim, or, if you have paid nothing, to zero.
These limits apply to every claim in aggregate, not per claim, and they survive any failure of an essential purpose of any limited remedy.
Nothing in these Terms excludes or limits liability where such an exclusion or limitation is not permitted by applicable law, including liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or under mandatory consumer-protection law. Nothing in these Terms affects your mandatory rights as a consumer, and where a term is unlawful in your country, it applies only to the extent it lawfully can.
14. Indemnification
To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless the developer and any contributors, licensors, and service providers from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or in connection with your use of the App, your breach of these Terms, your use of third-party plugins, hardware, or services, the music or files you play, store, or transfer, or your infringement of any third-party rights (including copyright or other intellectual-property rights).
15. Individual claims only
To the maximum extent permitted by applicable law, all claims must be brought in the parties’ individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding.
16. Suspension and termination
Your licence ends automatically when your trial or subscription ends. Access may also be suspended or terminated, without notice and without liability, if you breach these Terms: in particular if you share subscription access with another person, attempt to bypass the subscription or licence checks, interfere with the App or a store’s services, or use the App unlawfully. Termination for breach does not entitle you to a refund of any amount already paid, except where mandatory law requires one, and it does not limit any other remedy available.
You may end this agreement at any time by cancelling your subscription (Section 5) and uninstalling the App.
17. Changes to the App and to these Terms
The App changes as it is developed: features may be added, altered, suspended, or withdrawn at any time, and support for particular devices, operating-system versions, protocols, or formats may end, without liability.
These Terms may be updated as that happens. Material changes will be reflected by an updated “Last updated” date above and, where required by applicable law or store policy, additional notice will be given or consent sought before they take effect. Continuing to use the App after an update takes effect means you accept the revised Terms. If you do not accept them, cancel your subscription as described in Section 5 and stop using the App.
18. Governing law and resolving disputes
These Terms, and any dispute arising from them or from your use of the App, are governed by the laws of Ukraine, without regard to conflict-of-law principles, and are subject to the exclusive jurisdiction of the courts of Ukraine, except where mandatory consumer-protection law of your own country of residence gives you the right to bring a claim in your local courts or under your local law instead, in which case that law controls to that extent.
Before starting any formal proceeding, you agree to contact support@bit-perfect.com first, describe the issue, and allow a reasonable period (at least 30 days) to resolve it informally. Billing, purchase, and refund disputes are handled directly between you and the store you purchased through, under that store’s own rules and dispute-resolution process.
19. Apple App Store: additional terms
Where you obtained the App from the Apple App Store, the following also applies and, on these points, prevails:
- These Terms are between you and the developer only, not with Apple. Apple is not responsible for the App or its content.
- Apple has no obligation to provide any maintenance or support for the App.
- If the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App, and any other claims, losses, liabilities, damages, costs, or expenses attributable to a failure to conform to a warranty are the developer’s responsibility, subject to the limits in Section 13.
- The developer, not Apple, is responsible for addressing any claim by you or a third party relating to the App, including product-liability claims, claims that the App fails to conform to a legal or regulatory requirement, and claims under consumer-protection or similar legislation, and for the investigation, defence, settlement, and discharge of any third-party intellectual-property infringement claim relating to the App.
- You represent that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not on any U.S. Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, have the right to enforce them against you.
20. General
Severability. If any provision of these Terms is held invalid, illegal, or unenforceable under applicable law, it will be modified to the minimum extent necessary to make it valid and enforceable (or, if it cannot be, severed) and the remaining provisions continue in full force.
No waiver. A failure or delay in enforcing any provision is not a waiver of it, and no single or partial exercise of any right prevents any further exercise of it.
Assignment. You may not assign or transfer these Terms or your subscription without prior written consent. These Terms may be assigned freely, including in connection with a transfer of the App.
Events outside reasonable control. No liability is accepted for any failure or delay caused by events outside reasonable control, including network or power failures, acts of war or armed conflict, natural events, changes in law, or the acts, outages, or policy changes of any platform, store, or third-party service the App depends on.
Export and sanctions. You agree not to use or export the App in violation of any applicable export-control or sanctions law.
Survival. Sections 6, 10 to 16, 18, and 20 survive the end of your subscription and of this agreement.
Trademarks. All third-party trademarks, service marks, product names, and brand names (including Chromecast, DLNA, UPnP, Android, iOS, macOS, Google Play, and Apple App Store) referenced in the App or in these Terms are the property of their respective owners. Reference to them does not imply affiliation, sponsorship, endorsement, or approval.
Language. These Terms are written in English. Any translation is provided for convenience, and the English version governs to the extent permitted by applicable law.
